These Terms & Conditions govern your use of the LUCID Nightscapes website and related online materials. By using our website, submitting an inquiry, requesting a consultation, uploading files, or communicating with us through the website, you agree to these Terms & Conditions.
If you do not agree with these Terms, please do not use our website.
1. About LUCID Nightscapes
LUCID Nightscapes LLC, doing business as LUCID Nightscapes, provides outdoor lighting, outdoor sound, and related design-focused services in the Greater Orlando area.
Our services may include, depending on project fit and availability:

Service availability, scope, pricing, timelines, materials, and project requirements vary by property and are determined through consultation, proposal, and written agreement.
2. Website Information Is General
The information on this website is provided for general informational and marketing purposes only. It does not create a binding quote, contract, warranty, guarantee, professional obligation, or client relationship.
Images, renderings, demos, descriptions, service examples, and project concepts shown on the website are illustrative. Actual results may vary based on property conditions, fixture selection, installation limitations, HOA or community restrictions, weather, site access, materials, budget, design decisions, and other factors.
3. No Guarantee of Final Results from Demos, Renderings, or Concepts
Nighttime demos, design concepts, mockups, renderings, illustrations, photos, and recommendations are intended to help communicate possible design direction. They are not guarantees of final appearance, exact brightness, fixture count, beam spread, color temperature perception, shadow pattern, plant growth interaction, or final project outcome.
Final results depend on the approved scope, fixture selection, installation conditions, aiming, property layout, landscaping, surfaces, ambient light, maintenance, and other real-world conditions.
4. Contact Forms and Project Inquiries
Submitting a contact form or project inquiry does not guarantee acceptance of a project, availability, pricing, service eligibility, or a specific response time.
You agree that information you submit is accurate to the best of your knowledge and that you have authority to request services for the property or project location provided.
We reserve the right to decline inquiries, consultations, demos, estimates, or projects for any reason, including location, scope, feasibility, licensing, safety, scheduling, access, budget, or compliance concerns.
5. Project Photos and Uploads
If you upload photos, videos, documents, or other materials, you confirm that you have the right to share them with us for project evaluation, planning, design, estimating, and communication purposes.
You grant LUCID Nightscapes permission to review, store, and use uploaded materials for project-related purposes. Do not upload confidential, sensitive, or private materials that are not necessary for evaluating your project.
6. Consultations and Nighttime Demos
Consultations and nighttime demos may be offered at our discretion based on location, project type, scheduling, and project fit.
Nighttime demos may be offered at no charge within a reasonable service distance. Projects outside a reasonable distance may require a travel fee, demo fee, or other charge. Any applicable fee should be communicated before the demo is scheduled.
A demo is not a final design, final proposal, or guarantee of final project outcome.
7. Estimates, Proposals, Contracts, and Final Project Terms
Any estimate or proposal provided by LUCID Nightscapes is subject to change until accepted in writing and confirmed through the applicable proposal, invoice, contract, or service agreement.
Final pricing, payment schedule, deposit requirements, materials, fixture counts, scope of work, warranties, timelines, exclusions, cancellation terms, and project-specific obligations are controlled by the written proposal, invoice, contract, or service agreement for that project.
If there is a conflict between this website and a signed or accepted project-specific agreement, the project-specific agreement controls.
8. Deposits, Cancellations, and Refunds
LUCID Nightscapes currently accepts payments through approved third-party payment processors, invoicing systems, proposal platforms, project management tools, or other business payment methods. Payment options, deposit amounts, due dates, and processing details may vary by project.
Unless otherwise stated in a written proposal, invoice, contract, or service agreement, deposits are generally non-refundable once a project is accepted, scheduled, materials are reserved or ordered, design work begins, administrative work begins, HOA or compliance coordination begins, or project planning begins.
If LUCID Nightscapes is unable to perform an accepted project for reasons within our control, we may, at our discretion and subject to the applicable written agreement, offer a refund, partial refund, credit, rescheduling option, revised scope, or other appropriate resolution.
Specific cancellation, rescheduling, refund, and payment terms may vary by project and should be confirmed in the project-specific written agreement.
9. Scheduling, Access, and Site Conditions
Project timelines and appointment times are estimates unless clearly stated otherwise in a written agreement. Scheduling may be affected by weather, site access, material availability, permitting, HOA approvals, third-party coordination, property conditions, customer delays, safety concerns, or other circumstances.
You are responsible for providing safe and reasonable access to the property, notifying us of known hazards, underground utilities, irrigation, pet containment systems, private wiring, access restrictions, HOA rules, gate codes, parking limitations, and any other conditions that may affect the work.
10. HOA, Community, Permit, and Compliance Requirements
Some projects may be subject to HOA rules, architectural review, community restrictions, municipal requirements, utility rules, permit requirements, easements, or other approvals.
As part of our project process, LUCID Nightscapes may assist with, prepare, coordinate, or submit HOA and community approval materials when included in the project scope or otherwise agreed in writing. This may include helping organize design details, product information, fixture locations, renderings, photos, descriptions, or other materials commonly requested for review.
You are responsible for providing accurate HOA information, community guidelines, architectural review requirements, property ownership authority, portal access, forms, deadlines, contact information, and any other information needed to support the approval process. You are also responsible for making final owner decisions and confirming that submitted information is accurate.
Although we may assist with or manage HOA-related submissions, approval is ultimately controlled by the HOA, architectural review board, community association, municipality, or other reviewing authority. LUCID Nightscapes cannot guarantee approval, response times, review outcomes, or requested revisions.
LUCID Nightscapes may recommend design adjustments, revise submissions, delay scheduling, or decline work if compliance concerns, safety concerns, site limitations, or approval issues arise.
11. Licensing and Licensed Professionals
Certain work may require licensed professionals, permits, inspections, approvals, or supervision depending on the scope, location, and applicable law.
Where required, LUCID Nightscapes may coordinate with, subcontract to, work under the direction of, or refer work to properly licensed professionals. We reserve the right to modify, decline, delay, or separate portions of a project when licensing, permitting, electrical, structural, safety, or compliance issues are present.
Nothing on this website should be interpreted as a promise that every service shown is available in every situation or may be performed without additional licensed trade involvement.
12. Materials, Fixtures, and Product Availability
Fixture styles, finishes, materials, technology, smart controls, transformers, speakers, lighting accessories, and other products may vary based on availability, supplier changes, site needs, manufacturer updates, discontinued items, and project-specific design requirements.
We may recommend substitutions or alternatives when necessary. Final material selections should be confirmed in the applicable proposal, invoice, contract, or service agreement.
13. Maintenance and Long-Term Performance
Outdoor lighting and sound systems may require adjustment, cleaning, vegetation trimming, fixture aiming, lens cleaning, wire or connection checks, transformer review, app or control updates, and other maintenance over time.
LUCID Nightscapes offers maintenance plans for customers who want ongoing system care, seasonal adjustments, cleaning, inspection, fixture aiming, troubleshooting, and performance support. Maintenance plan details, visit frequency, pricing, included services, and exclusions are controlled by the applicable maintenance agreement or written proposal.
Plants grow, landscaping changes, weather occurs, mulch shifts, and outdoor environments are naturally variable. Long-term performance may depend on routine maintenance and property conditions.
Unless included in a written agreement, ongoing maintenance is not included automatically.
14. Portfolio, Photography, and Marketing
Unless otherwise agreed in writing, LUCID Nightscapes may photograph or record completed work for portfolio, website, social media, advertising, internal training, or marketing purposes.
When practical, we avoid displaying sensitive or clearly identifying information, such as visible street addresses, house numbers, license plates, private documents, or street names.

15. Intellectual Property
All website content, including text, designs, layouts, graphics, logos, images, service descriptions, design concepts, branding, and other materials, is owned by or licensed to LUCID Nightscapes unless otherwise stated.
You may not copy, reproduce, modify, distribute, sell, or use our website content, branding, designs, or materials for commercial purposes without written permission.
Design concepts, layouts, renderings, plans, sketches, mockups, and recommendations prepared by LUCID Nightscapes remain the intellectual property of LUCID Nightscapes unless a written agreement states otherwise.
16. Third-Party Links and Tools
Our website may contain links to third-party websites, platforms, scheduling tools, payment processors, maps, analytics services, social platforms, or embedded content. We do not control and are not responsible for third-party websites, services, policies, content, or practices.
Your use of third-party services may be subject to their own terms and privacy policies.
17. Limitation of Liability
To the fullest extent permitted by law, LUCID Nightscapes is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the website, reliance on website content, submission of information, website interruptions, third-party services, or project inquiries.
Website content is provided “as is” and “as available” without warranties of any kind, whether express or implied.
Nothing in these Terms limits liability that cannot legally be limited under applicable law.
18. Indemnification
You agree to defend, indemnify, and hold harmless LUCID Nightscapes LLC, its owners, team members, representatives, contractors, vendors, and affiliates from claims, damages, liabilities, losses, costs, or expenses arising from your use of the website, information you submit, materials you upload, your violation of these Terms, or your violation of another person’s rights.
19. Changes to the Website and Terms
We may update, modify, remove, or discontinue any website content, service description, feature, or page at any time without notice.
We may update these Terms & Conditions from time to time. The updated version will be posted on this page with a revised “Last Updated” date. Your continued use of the website after changes are posted means you accept the updated Terms.
20. Limited Lifetime Fixture Warranty
For eligible landscape lighting installations, LUCID Nightscapes may offer a limited lifetime warranty on qualifying fixture bodies for select fixture categories, including spotlights, pathway lights, and hardscape lights, when specified in the applicable written proposal, invoice, contract, or warranty documentation.
This limited lifetime fixture warranty applies to eligible fixture body defects or failures caused by manufacturer defect, material defect, or poor fixture craftsmanship under normal use. If an eligible fixture qualifies for warranty replacement, the customer will not be charged for the replacement fixture itself. A minimal service fee, trip fee, diagnostic fee, or labor fee may still apply for us to visit the property, evaluate the issue, remove the failed fixture, and install the replacement.
This warranty does not cover LEDs, lamps, bulbs, LED boards, LED modules, drivers, transformers, wiring, wire connections, smart controls, timers, hubs, speakers, audio equipment, bistro lights, solar bollards, temporary lighting, accessories, finishes affected by normal aging or patina, or any item not specifically included in writing.
This warranty does not cover damage, failure, or replacement caused by misuse, abuse, alteration, relocation, improper maintenance, unauthorized repairs, landscapers, lawn equipment, pets, pests, flooding, lightning, power surges, hurricanes, severe storms, falling branches, construction activity, vandalism, theft, accidents, chemical exposure, irrigation issues, normal wear and tear, or other conditions outside normal fixture craftsmanship or material defect.
If damage or failure is caused by the customer, landscaper, third party, weather event, site condition, improper use, or excluded cause, the customer will be responsible for applicable labor, parts, fixtures, materials, service fees, and replacement costs.
If an exact replacement fixture is discontinued, unavailable, or materially changed, LUCID Nightscapes may provide a reasonably comparable replacement fixture at our discretion, subject to availability and the applicable written agreement.
Warranty eligibility may require proof of original installation by LUCID Nightscapes, continued use at the original installation location, reasonable system care, and no unauthorized modification or relocation. Warranty coverage is subject to the final written proposal, invoice, contract, warranty documentation, and any applicable manufacturer terms.
Unless otherwise stated in writing, warranty coverage is limited to the original customer and original project location and is not automatically transferable.
21. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
